In my experience, the treaties the defenders offer are something like, "Give us back everything you took from us, and then some".  

In other words, they're asking the realm winning the war to surrender to the realm losing the war.

Aside from the sheer absurdity of it, if you have to give back every region that has a claim on it anyway, what's the point of making peace?
