If by cheating, you mean cheating as a player, like running multiple
accounts, or exploiting bugs, or finding loopholes to game mechanics, or
something like that, then no. Because the action is completely
in-character. There's no exploitation of game mechanics or OOC
knowledge involved, so it's not "cheating" in that sense.
If by cheating, you mean, in-character, exploiting a loophole that gets
you out of the treaty, then it's really up to the characters in the
enemy realm to decide if it's cheating or not. I suspect most
characters would consider it to be cheating the treaty, and would take
some action as a result.
Whether it's smart depends on the other realm. If the other realm let
you get away with it, then it's smart. If the other realm take offense,
declare war on you, claiming it's a violation of the spirit of the
treaty, and destroy you, then it's not smart. Though if they do that
and you destroy them, then maybe it is smart after all.
So - not cheating as in bad Sandra, get banned from game. But maybe a
sort of "cheating" as in bad Sandra's character, get attacked in-game.
