Why not? I would think the influence of being a Duke is rather like that 
of being a noble - you have certain expectations of what you can do (if 
the ability of nobles to be treated appropriately went out the window 
when they were away from their stomping grounds, how can they 
emigrate?). It's not only that you have more land/gold/political 
influence than the other guy (though that clearly helps augment the 
power of a Duke), there's a base amount of power in the name itself that 
grants you the privilege to, in this case, refuse duels.
