I am not sure this is entirely accurate. I have both a Judge character
and infil character. When I picked up an infil with a previous ban via
patrols, I was presented with something resembling this.
/Execute - You cannot execute this prisoner as they are not a
criminal.
/It has been a while since I have had to deal with this, so something
may have changed, but I distinctly remember not being able to deport or
execute an infil even though he had a previous ban. On the flip side,
my infil character has been snagged by patrols many times in realms he
was previously banned and has never been deported because of it or
(obviously) executed. Now it could be that I was lucky, or that my
memory is fading with my eyesight, but this is what I believe to be
true.

Well, the situation that brought this question up was resolved with the
infiltrator being killed by a judge so... That's pretty much a very
solid answer.
