I am absolutely, 100% certain.  I have done it myself.  You can  
torture *ANY* character all you like and they won't die.  If you  
*EXECUTE* a rogue/outlaw character, it will *tell* you you publicly  
tortured them to death. (And I think there's less honour loss, but  
I'm not as certain about that part.)
