[Discuss] quick infiltrator question

If an infil has a ban in an enemy realm and get's picked up by a random
patrol can the judge of the enemy realm torture or kill that infil? 
 
I am under the impression that if you get snagged by a random patrol
you're just basically sitting there doing nothing since you were not
committing a crime at the time. Is that wrong?
